Booking Terms and Conditions

CHECK OUT TIME: 9 am (QLD time)
1. The terms & conditions of the holiday letting agreed to by both parties are as follows, and withdrawal from the same by you permits the owner or agent to refuse the key and amend the charge or immediately terminate the occupancy.
2. The premises are let to you for holiday purposes only.
3. If a rate was negotiated for longer term holiday accommodation, that rate is payable regardless of the booking being cancelled at an earlier than agreed date.
4. All bookings are from Saturday to Saturday (unless otherwise stated). The premises are available from 12 noon QLD time on the day of arrival (earlier only if available) and are to be vacated by 9am QLD time on the day of departure. Keys must be collected from our office and be returned to our office. A key chute is provided at the front of our office door for after hours. Any late departures will incur a fee. A maximum of two sets of keys per tenancy can be provided & must be returned.
5. An amount equal to 50% of the 1st weeks rent OR $300 minimum, is required as a deposit on bookings exceeding 1 week, for bookings of 1 week or less full payment is required and is payable within seven (7) days of making a booking, or the booking will be cancelled.
6. Rent for the full period of the booking must be paid by cash, cheque, money order (made payable to Rainbow Bay Realty Pty Ltd) or credit card (VISA or Mastercard only) before occupancy. A Check-In registration form is required to be completed upon check in and current credit card details with the card holders signature are essential as a security deposit for bookings (if no credit card, alternative arrangements must be made with our office prior to check-in) Please complete the booking sheet and present on arrival. A cash bond may be incurred for group bookings or at our discretion.
7. All bookings are made in good faith; however we are bound by any subsequent instruction received from the landlord. Whilst Rainbow Bay Realty will endeavor to honor all bookings, they can not accept responsibility for instructions from landlords.
8. Our staff will describe the premises, position and furnishings to the best of their ability and in good faith. No responsibility or refunds for alleged mis-description can be accepted.
9. When a booking is made, the deposit is accepted for the owner at that time. If the property is sold and the ownership changes before your booking begins, we cannot guarantee that the property will remain available as holiday accommodation.RainbowBayRealty cannot accept responsibility for decisions made by a new owner. If the property is sold, you will be notified, and all alternative options will be outlined.
10. If your holiday property is listed for sale while you are in residence, the occupier agrees to allow the owner or agent to conduct inspections with prospective purchasers at mutually convenient times, by appointment.
11. All rental rates are subject to increase without notice. Should this occur you will be notified and given the opportunity to pay the difference in tariff or receive a full refund of your deposit. Alternate accommodation will be offered if possible.
12. All properties under Rainbow Bay Realty management are privately owned and are rented on a fully self contained basis. In the event of faults and/or malfunctions of appliances or inclusions, there is no obligation from the owner or Rainbow Bay Realty to compensate or discount your accommodation.
13. At times situations arise of which we have no control.RainbowBayRealty reserves the right to move visitors to alternate accommodation (subject to availability) at their discretion or the direct instruction of the property owner. If this is the case, we will notify you as soon as possible and make every reasonable effort to make sure you are satisfied with your new address.
14. Should a tradesperson be sent out upon your request to carry out a repair that was unnecessary, the cost of the callout will be charged to you.
15. Linen is generally not supplied (there are a few exceptions) Please check with our office. You can bring your own Linen or it may be hired through our office at a charge. Please note linen must be used on all bedding.
16. Dogs or any other animals are strictly not allowed in or about the premises.
17. At no time during the occupancy by the tenant shall the number of persons residing overnight exceed the number of beds. Each holiday property is equipped for a specific number of guests. It is against Health Department regulations for more persons to occupy a property than there are beds to accommodate them. No mattresses, tents or caravans, or more cars than the property accommodates are allowed. If a property is reported to be overloaded, the tenants will be asked to vacate immediately with no refund made. If required, we can arrange cots for young children at an additional charge.
18. Units are quoted for family groups only and not for parties of single girls and/or boy’s.
19. The agent will not be responsible for alternate accommodation or any other cost when tenants arrive after hours.
20. The tenant will be responsible for any damage to the premises or loss or damage to any items in the premises including but without limiting the generality of the foregoing, furniture, kitchen utensils, crockery, cutlery and fittings and the tenant will within 7 days of a demand by the Agent pay to the Agent the cost of replacement or repair (at the discretion of the agent) of any such item damaged or lost.
21. The premises must be kept clean; additional cleaning fees apply if the unit is not left how it is found. Dishes must be washed, dried & put away, rubbish must be removed from the property and furniture must be left where found, in the property, upon arrival.
22. Fish must not be cleaned on the premises. Garbage is to be placed in wheelie bins provided, not left inside the unit. Garbage bins are provided with all properties. Please ensure that all garbage is removed from your holiday property and placed in bins provided. Please read the sign in your holiday property for garbage collection day. You are required to place the bin on the curb side for collection with the handle facing the property.
23. Where applicable The Body Corporate By-Laws must be observed. It is a breach of Body Corporate By-Laws to hang clothes, towels or other articles over balconies. Repairs for damages to any common property must be paid for by the person who committed the damage.
24. Vehicles must be parked in the specific area allocated to the unit you are occupying.
25. Duplicate keys are not always available. Tenants are liable for damage caused when doors or windows have to be forced open, or if a locksmith is called out due to keys being lost or stolen or locked inside. If keys and/or remotes are lost you will be responsible for the changing of the locks and 3 remotes (if applicable) and the cutting of 3 new sets of keys. Should a guest require duplicate keys after hours a $30 cash service fee is applicable. If no spare keys are available, tenants may be liable for any costs involved in gaining entry to premises. The keys are your responsibility so please take care of them.
26. All guests are responsible for keeping the property secure during their stay and will be responsible for any theft or damage due to neglect in this area.
27. When a guest registers or an invitee of a guest enters the premises, they are deemed to be bound by these agreements.
28. No liability is accepted for any injury, debt, damage, loss, delay, expense or inconvenience caused directly or indirectly by events beyond the agent or owners control. No responsibility is taken for guests personal property left on or near the premises. It is recommended that guests take out personal property insurance or adequate travel insurance should any unexpected situations arise before or during your travel period
29. All guests are responsible for any loss or damage arising from breakages or other damage to the unit or common property during their stay, including any additional cleaning, removal of excess garbage, repairs or replacement of items in the property. All properties are privately owned. Please respect the owner's property and do not move furniture around. A fee may be charged should this occur and the tenant will within 7 days of a demand by the Agent pay to the Agent the cost of replacement or repair (at the discretion of the agent) of any such item damaged or lost. Do not move items from property to property.
30. Unfortunately, as our units are so widely spread we are unable to deliver messages. However, any messages given to us will be placed in our message bag located at our office 231 Boundary Street Coolangatta
31. Left Items - if requested we will endeavor to recover and return items of value inadvertently left in your holiday property, but take absolutely no responsibility for the recovery or return. Postage, packaging and the cost of sending out a staff member to search for the item will need to be paid in advance; a minimum cost of $20.00 applies. Low value items found will be held for claiming for a maximum of 2 weeks and if not claimed will be disposed of.
32. Future bookings are to be made during the first week of occupancy or the property may be offered to other parties.
33. Rainbow Bay Realty reserves the right to refuse any booking request if they believe it is not in the best interest of the owner or the property.
RAINBOWBAY REALTY CANCELLATION POLICY
Special conditions apply for cancellations. If you cancel your accommodation and we can secure a replacement booking for the same period and at the same tariff, your deposit will be refunded less a $60.00 administration fee. If however the property cannot be re-let, your deposit is not refundable. If you shorten your stay, the unused portion of your rental is not refundable. RainbowBayRealty retains the right to negotiate the tariff or length of stay to obtain a booking on a cancelled booking as we deem necessary. Please note that a change of booking dates attracts the same conditions for cancellations as stated herein.
FOR ANY OTHER REASON OR TIME OTHER THAN THE ABOVE CANCELLATION FEE WILL BE AT AGENTS DISCRETION
PLEASE READ THESE CONDITIONS CAREFULLY AS ANY DEPARTURE FROM SAME PERMITS THE OWNER OR THE AGENT TO REFUSE THE KEY, AMEND THE RENT OR IMMEDIATELY TO TERMINATE THE TENANCY AND NO REFUNDS WILL APPLY.
